PRICES
All prices listed in our website, advertisement and/or EBay® includes all shipping & handling charges. All prices are mail order prices. They do not include any fees or charges that may be imposed by HM Customs and Excise. We recommend customers check with HM Customs and Excise for any applicable charges prior to making a puchase with Evil Performance.

TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from the supplier or manufacturer, Evil Performance® shall have the right to refuse or cancel any order placed for product listed at the incorrect price. Evil Performance® shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, Evil Performance® shall immediately issue a credit to your credit card account in the amount of the charge.

WARNING
All parts sold by Evil Performance®, except for street legal/DOT approved parts, are racing parts for off road use only. Installation of this part may void the warranty coverage, if any, on your vehicle. Evil Performance® shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. Evil Performance® shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. Evil Performance® will not cover any loss in profit or labor due to errors in shipping, insufficient packaging, and/or extended delays for backorder items. Evil Performance® shall not be held accountable for any misconception or disappointment associated with any product.

SPECIAL ORDERS
Evil Performance® will determine special order items. All special ordered items must be prepaid before processing your order. Special ordered items cannot be cancelled or returned.

PAYMENT
Evil Performance® accepts all major credit cards via Paypal®, money orders, and certified cheques payable to Evil Performance®. Bank transfers are also accepted. All cheques will be subject to a minimum of (14) fourteen-business day waiting period to clear with our bank. Orders will not be processed or shipped until this waiting period is over. Credit card fraud will not be tolerated. All orders paid by credit card must be shipped to the cardholders billing address or verified alternate shipping address. Orders will NOT be shipped if the address provided does not match the records of the credit cardholder’s bank.

SHIPPING
All orders are shipped by either EMS or a pre-designated courier. Evil Performance® does not guarantee on time delivery for out of stock items. Any expected shipment dates given to customers are approximate. Items shipped from Japan on international order can take up to six (6) weeks to be delivered. Once products are dispatched, an EMS tracking number will be issued along with instructions on how to track international delivery items. Out of stock items will be placed on backorder. Backorder items will ship within 24hrs after receipt of shipment from manufacturer. Please check whether your item may be subject to import fees or customs charges prior to placing an order with Evil Performance. By placing an order, you agree to any charges that may be imposed. Evil Performance is not liable for any charges incurred by HM Customs and Excise.

REJECTION OF GOODS
As soon as the goods are delivered to Buyer, they shall inspect them. Notice must be given within two (2) days after receipt of goods of any defect or omissions. Failure to give notice within two (2) days after receipt shall constitute an irrevocable acceptance of the goods.

CLAIMS
Claims for defective goods, shortages, delays, or failures in shipment or delivery, or for any other cause, shall be deemed waived and released by Buyer, unless made in writing within five (5) days after the arrival of the goods.

RETURNS
All items returned are subject to a 25% (twenty-five percent) restocking fee. Returns are not accepted on ignition systems, computers, electrical units, bulbs, lighting accessories, software, special orders and custom orders. All other returns or exchanges are accepted within 15 days after date of invoice. It is the customer’s responsibility to contact Evil Performance® within this time period to be eligible for a return. All returns must be unused, in the same condition as sold to buyer and in its original packaging. Returned parts with missing packaging, instructions, or parts will be subject to a restocking fee. The returned item(s) must be accompanied with a copy of the original invoice. No returns or exchanges will be allowed if the item shows signs of having been installed, scratched, damaged or modified. Wheels and tires, which have been mounted, are not returnable. If Evil Performance® does not accept a returned item as being defective and/or returnable for any reason, the buyer must accept any incurred cost. It is the responsibility of the customer to verify the correct part before ordering and installing a particular part.

REFUNDS
A refund, exchange or core return will not be made until all items are returned to Evil Performance®. Shipping and handling charges are non-refundable. Orders placed by credit card will be refunded to the same credit card account only. All other non-credit card orders will be refunded by either company check or store credit. Refused shipments sent back to Evil Performance® do not constitute a refund or credit. Evil Performance® reserve the right to charge the customer shipping & handling costs for the refused shipment and a 25% restocking fee.

INTERNATIONAL ORDERS
All orders outside of the UK must be paid in full before shipment is arranged. All foreign orders are final. No returns will be accepted; therefore it is the buyer’s responsibility to order the correct part. Evil Performance® does not guarantee proper fitment for buyers foreign vehicle as all parts sold by Evil Performance® are made for the Japanese domestic market.

WARRANTY
All products sold by Evil Performance® are only subject to the manufacturer’s warranty. Manufacturer warranty will not be honored if the customer’s mishandling, abuse or faulty installation causes the defect.
